Terms of sale

These conditions govern every purchase made on https://handsdownbeauty.com/. They explain how a contract is formed, how prices and payment work, when risk and title pass to you, and how disputes are handled.

1. Scope

These Terms and Conditions of Sale apply to every purchase made on https://handsdownbeauty.com/ by a consumer. Placing an order means that you have read, understood and accepted them. They should be read together with our Shipping Policy and our Return and Refund Policy, which form an integral part of them.

2. The seller

3. Ordering process

Select your products, add them to your cart, and proceed to checkout. Before confirming payment you can review your cart, correct any error and check the total price including shipping and any applicable tax. Confirming payment constitutes an offer to buy.

4. Formation of the contract

You will receive an order acknowledgement by email. This acknowledgement confirms receipt of your order and does not constitute acceptance. The contract of sale is formed only when we send you a dispatch confirmation for the items concerned. Where an order contains several items, the contract is formed separately for each item as it is dispatched.

5. Prices and taxes

Prices are displayed in United States dollars. Applicable sales tax, where required by the destination state, is calculated and shown at checkout before payment. Shipping costs are shown separately. The total amount payable is always displayed before you confirm.

6. Payment

Payment is taken in full at the time of the order, using the payment methods displayed at checkout. Payments are processed by our payment providers over an encrypted connection. We do not receive or store your full card number. Your order is processed once payment has been authorised. If a payment is declined or later reversed, we may cancel the order.

7. Availability

Our offers are valid while stocks last. If a product becomes unavailable after your order has been placed, we will inform you promptly and refund that item in full. Where only part of an order is affected, the remainder will be dispatched normally.

8. Delivery

Orders are dispatched within 24 to 48 hours and delivered within approximately 6 to 12 business days for the continental United States. Full details, including estimates for Alaska, Hawaii and military addresses, are set out in our Shipping Policy.

9. Transfer of risk and title

Risk in the products passes to you on delivery. Title passes to you once we have received payment in full.

10. Returns, refunds and cancellation

Your right to cancel, to return and to obtain a refund is set out in full in our Return and Refund Policy. In summary: you have thirty days to request a return, sealed cosmetic items that have been opened or used cannot be returned for hygiene reasons, and faulty, damaged or incorrect items are replaced or refunded in full at our cost.

11. Conformity of the products

Products are supplied in conformity with their description on the website. If a product does not conform, contact us within thirty days of delivery and we will replace it or refund it. Minor variations in shade or finish between production batches are normal and do not constitute a lack of conformity.

12. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, customs action, industrial action, severe weather, natural events, epidemics or public health measures. Where such an event lasts more than thirty days, either party may cancel the affected part of the order and we will refund it in full.

13. Complaints and dispute resolution

Please contact us first at hello@handsdownbeauty.com so that we can resolve the matter directly. We aim to acknowledge every complaint within one business day and to resolve it within five. Any dispute that cannot be resolved amicably is governed by the laws of the State of Wyoming, United States.

14. Severability and entire agreement

If any provision of these conditions is held invalid, the remaining provisions continue to apply. These conditions, together with the Shipping Policy, the Return and Refund Policy, the Privacy Policy and the Terms of Service, constitute the entire agreement between you and us in relation to your purchase.
